relief as the little 5-year-old boy has been freed from the hands of this suspect jimmy lee dykes. they told us he was in eminent danger. the constant communication between the suspect and negotiators was beginning to deteriorate. it is unclear how but they confirmed he was holding a gun and the situation was becoming tense. remained so after the incident because last night they continued to sweep his property and check for buried bombs as the boy was taken to the local hospital. >> he is doing fine. he is laughing, joking, playing, eating, the things that you would expect a normal 5 to 6-year-old young man to do. he is very brave. he is very lucky and the success story is that he is out safe and doing great. >> we were at the hospital last

night and spoke to fbi officials on the scene. they told us he was safe and he was okay. they released no details about his condition. what we all know is that little 5-year-old boy had been under a bunker with a murder suspect for at least a week. he witnessed two killings in just a week span. >> elizabeth, we will check with you later. >> community's tr prayer's answ. >> the former marine accused of killing chris kyle is under suicide watch. camera surveillance at a texas jail. he tadzerred him and tied him to a chair after he tried attacking them last night. the kyle family is speaking out for the first time saying his brother jeff is quote lives by a professional motto it is our

duty to serve those who serve us. he died honoring this creed. treasury nominee jack lieu coming under scrutiny. they are questioning whether he violated federal laws by failing to respond to the group that oversees medicare. the group led by jeff sessions lames lew is unfit to be treasury secretary. >> an appeal supreme court justice ruth gator ginsburg rejected the first filing to come after that filing. they made the emergency request. the board forced the company to rehire 700 employees. it involved in a labor dispute. they wanted the supreme court to halt that. lance armstrong is going to take the money and run. an attorney says he has no plans to pay back the bonus money for

winning the tour defrance. that amounts to nearly $12 million. armstrong confessing he cheated and doped his pway to the title. he says athletes shouldn't have to return the compensation. the company is plan to go file a lawsuit. >> superdome officials say there was a chance the power could go out for the super bowl. tests show the electrical meet feeds were decayed and there were concerns about power failures since back then. they had a backup generator and was just about to turn it on when the power came back. don't blame beyonce for that. the show operated on its own power grid. that is your 5@5:00. in just a few hours president obama will turn his attention back to immigration reform. he's hosting ceo's as well as labor leaders at the white house to talk about it.

kelly wright is talking about it this morning. >> good morning to you. this is an important step for the president in dealing with or meeting the demands of gaining approval for comprehensive immigration reform. he will meet with business and labor leaders to talk about the economic agenda. his plans for immigration reform and how it fits into the economy. he is pushing for bipartisan strategy lawmakers for immigration reform and the passes. a week ago a group of 8 senators from both sides of the aisle republican and democrats outlined principles calling for tighter border security, a guessworker program a pathway to citizenship and employment verification. to think that 11 million are living among us without document station. we need to give them a chance to

earn their way through citizenship by paying taxes, establishing they are no threat to america by their background and meet the basic standards we require. >> both sides appear to be willing to get the job done he cautioned if the plan does not include border security at that point it may not get done. >> the right kind of bill will benefit both parties president obama will get the achievement he fail to do deliver on in the first term and republicans can put the issue bind them. a bad bill will hurt the country. >> rove's success with immigration reform will be president obama how he accepts or declines or will he go with

breaking down the frightening new statistics and a new study. >> the new report by the corporation for enterprise development it shows nearly half of households in america don't have enough money saved for emergencies. it wouldn't last for a month if their income suddenly was gone. household earning 55 and 90,000 annually have less than 3 months of savings? how come? reports say between 2006 and 2010 median net worth declined whopping 27,000 dollars while the cost of living sky rocketed. difficult to come back on housing healthcare education they eat up three quarters of the average family's discretionary income. you are left with so much less in the end how do you save money. >> hard to do with college prices with hurricane sandy coming through and taxes going up and also gas prices going up. we have a new study out talking about gas prices last year and how much the american household

spent on gasoline. >> shocking numbers. last year turned out to be a real pain in the gas. american households spent a record amount filling up their cars more than $2,900 on average. in the meantime the cost for filling upkeeps going up in 2013 as well. the national average for regular unleaded costs 3.53 cents a gallon. prices jumped $0.18. that jump of that size we haven't seen anything like that in two years. the reason a lot of them higher crude oil prices, the economy switching over to the summer gasoline blends that's more expensive arise again in the tensions. there's so many reasons prices aren't coming down. >> i am saying consumption is going down but prices are going up. expenditures it's more expensive. >> thank you so much. it's time to brew on this.

captor for one week is now free. elizabeth pran is live for us in midland city, alabama with brand new details. what are we learning overnight about exactly what happened yesterday? >> well, we are learning very few details overnight. we heard from authorities late last night. he stormed the bunker and was able to free the 5-year-old boy for the first time in a week he was able to wake up with his mother just in time for his birthday. all eyes remain on this suspected killer jimmy lee dykes after the hostage standoff finally concludes the 5-year-old victim has been freed by law enforcement after they stormed that bunker. authorities say he was in eminent danger and the constant communication between the suspect and negotiators did begin to deteriorate and dykes became agitated. it is unclear exactly how they knew but they were able to confirm he was holding a gun and that the situation was becoming increasingly tense. >> within the past 24-hours negotiations deteriorated and

mr. dykes was observed holding a gun. at this point fbi agents fearing the child was in eminent danger entered the bunker and rescued the child. >> bomb squad officials combed the property after the incident checking for buried bombs. while the boy was taken to the hospital by first responders he was taken to flowers hospital ten miles from the crime scene. fbi officials post the boy is safe he is okay and he was with his mother. they released no details about his condition. but what we all know the little 5-year-old boy has been secluded in a bunker 4 feet under ground. he's gotten water and food and medication. they sent toys down to him through out the week. in the past week he has been witness to two killings perhaps a very long road ahead for that little boy.

around the earth. a mad dash for cash in shanghai. a man went to the bank losing most of it when the wind blew away. he was able to get back 1200 of the $2,800. what a bummer for him. >> ainsley thank you so much. the justice department is now suing standard and poors. it's the nation's largest credit rating agency. the agency played a huge role in the 2008 financial crisis. diane macedo from the fox business network has the details. the justice department is suing s&p saying the high ratings to mortgage bonds that tanked in value and fuelled the 2008 financial crisis. from september 2004 to october 2007 s&p knowingly defrauded investors in hopes of decreasing revenue and market share. the ratings firm suggest it is
